Same-Sex Sexual Harassment Victim Gets Severance

We represented an employee (“Client”) against a high-end department store chain (“Company”).

Client was a sales associate that experienced sexual harassment from other sales associates.  This same-sex sexual harassment continued unabated for over two years despite Client’s internal complaints to Company HR.  Client then filed a Charge of Discrimination with the U.S. Equal Employment Opportunity Commission.  Unfortunately, Client was not represented by counsel at that time and the EEOC found no probable cause.

We helped Client file a complaint in the United States District Court, Southern District of New York, entered an appearance, and less than four months later, Client received the severance check.  Company also agreed to not contest Client’s claims for unemployment insurance benefits.
